What is the Cancellation System for Qualified Stay?
I work in the foreign students section of a university in Osaka. A Russian student has not come to the university for four months now and we believe he is missing. His duration of stay remains more than one year and according to his classmates, he works in Tokyo. What will happen to his visa? We have not yet crossed him off our student list.
 

1) If he stays beyond the expiration date of his qualified stay visa, he will become an illegal overstayer and be deported. If it is true that he works in Tokyo without a permit, he will also be an illegal overstayer and deported. He may be imprisoned, confined, or imposed with a fine.

2) Apart from the above, if he fails to fulfill his obligations as a student for more that three months without good reason, the cancellation system for the qualified stay system which was recently introduced, will be adopted. If his conducts were regarded as malicious, he will be deported right away. If not, he will be granted an additional stay permit within 30 days so he can prepare for departure when his visa is canceled. During this period it is prohibited for him to work. Even if he enters an educational institute during this period, he is not able to apply for a student visa. If he leaves Japan and applies to enter Japan again, there is a possibility that he can study in Japan as a foreign student again.
